Mallya And Kingfisher Airlines Owe Rs 9,000 Crore To The Consortium Whose Leader SBI Had An Exposure Of Over Rs 1,600 Crore To The Now Defunct Airline.




In A Big Blow To Liquor Baron Vijay Mallya, The Supreme Court On Tuesday Handed Over To A Consortium Of 17 Banks In A Sealed Cover The List Of Domestic And Foreign Assets Owned By Him, His Three Children And Estranged Wife To Take “Action In Accordance With Law” For Recovery Of Over Rs.9,000 Crore Due From The Now Defunct Kingfisher Airlines. A Bench Of Justices Kurian Joseph And R F Nariman Told Mallya’s Counsel That The Businessman Had Not Complied With The Court’s April 7 Order Directing Him To Suggest A Firm Offer For Upfront Deposit, Complete Disclosure Of Assets In India And Abroad And The Date For His Personal Appearance Before The Apex Court, Either In “Letter Or Spirit”.


Mallya’s Lawyer Informed The Court That The Businessman Had No Plan To Come Back To India In The Near Future. The Government Said It Would Soon Move To Get Him Extradited From The UK. On Tuesday, Mallya Submitted A List Of Assets Held By His Entire Family In A Sealed Cover To The Court, With A Caveat Not To Disclose It Yo The Banks As These Properties Were Not Taken Into Consideration For Advancing Loans To Kingfisher Airlines.



The Bench Perused The List Of Assets And Said Mallya’s Personal Assets Were Worth Rs 2,017.36 Crore. However, The Court Didn't Disclose The Value Of Assets Held By His Children And Estranged Wife. The Bench Said Its April 7 Order Never Proposed Filing Of Asset Details In Sealed Cover And There Was No Application Seeking Modification Of The Order. It Accepted Attorney General MukulRohatgi’s Request That Since Mallya Was In Complete Breach Of The April 7 Order, The List Of Assets Should Be Handed Over To The Banks To Find Out Whether His Assets Were Held ‘Benami’ By His Children And Estranged Wife.

After Handing Over The List To The Banks, The SC Disposed Of The Petition Filed By The
Consortium Of 17 Banks Led By SBI And Directed The Debt Recovery Tribunal In Bengaluru To Decide The Matters Pending Before It In Two Months. Appearing For Mallya, Senior Advocates C S Vaidy Anathan And Parag Tripathi Told The Benchthat The List Of Properties Were Given In Confidence To The Court And It Should Not Be Breached To Force Mallya To Give Evidence Against Himself. “He Has Never Held Any Property Benami. The Children Are All US Citizens.

Mallya Himself Is An NRI And His Estranged Wife Has Been Residing In California For Two Decades. None Of Them Can Be Forced Under Law To Give Details Of Their Assets Held Abroad,” Vaidyanathan Said. He Told The Court That The Properties Held By The Children And Estranged Wife Were Earned By Them. “The Properties Transferred To The Children And Estranged Wife Were Much Prior To The Genuine Business Failure That Happened In Kingfisher Airlines.” Mallya’s Personal Assets Worth Rs 6,000 Crore Were Sunk In The Airlines Business Mainly Because Of The Adverse Circumstances Prevailing In The Sector, Vaidyanathan Said.
